Senior Manager, Financial Crime Compliance

Description:

The role is responsible for assisting the Group MLRO in the strategic development and execution of financial crime related program for the Group and overseeing the financial crime related program in the Asia region, especially for Hong Kong and Singapore.

Key Responsibilities:

Execution of the Group’s framework for managing financial crimes risk in the firm:

  • Act as the liaison point with regulators and law and enforcement agencies

  • Assisting the Group MLRO in leading the design/build and implementation of the following Financial Crimes Compliance elements for the Group:

    • Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) Program, including firm wide financial crimes related risk assessment

    • Sanctions program; and

    • Anti-bribery and corruption program.

  • Advise timely advice to the business regarding their obligations regarding Financial Crime including providing relevant learning and development, training to Directors

  • Advise on the development and maintenance of, and signing-off where appropriate, business area level financial crime procedures. Make practical recommendations where systems and procedures are in need of enhancing to counter the risk of financial crime.

  • Provide advisory support to the business on complex Financial Crimes Compliance matters (e.g. complex KYC, Sanctions queries)

  • Conduct the annual risk assessments relating to financial crime and incorporate conclusions into current policies and requirements. This includes obtaining relevant approval and sign off from the relevant Boards and Committees.

  • Support the business in capturing financial crimes obligations in the relevant risk and control self- assessments and ensure key controls are captured in the controls assurance program.

  • In conjunction with the Group and regional MLROs, ensure independent reviews are completed for higher risk transactions and client relationships (at on-boarding and periodic review) in line with policy requirements. Escalate exceptional transactions or relationships in line with policy.

  • Prepare, review and investigate suspicious activity reports and submit reports.

  • In conjunction with the Group and regional MLROs, support the issues management process to ensure that financial crime incidents are captured, analysed, escalated and reported as required, corrective action taken and progress reported.

  • Notify stakeholders, through timely reporting, all incidence of non-compliance with regulation and legislation.

  • Prepare regular reports, including MLRO reports to the Group MLRO, management, boards and committees summarising key issues, results, conclusions and actions taken. Reports to be suitable for the target audience.

  • Undertake investigations where required into suspected financial crime.

  • Co-ordinate the fulfilment of ad hoc requests/notices received from regulatory or law enforcement agencies in a timely manner.

  • Manage the development and delivery of financial crime training courses to staff.

Compliance Leadership:

  • Ensure an effective working relationship with colleagues in the global Compliance and Risk teams and in particular the Group MLRO, Regional Heads of Regulatory Compliance, local MLRO’s, the Global Head of Investment Compliance and the Heads of Risk.

  • Develop and maintain effective stakeholder relationships founded on trust and respect.

  • Take a proactive approach to issue resolution by encouraging collaboration across functions.

  • Influence key stakeholders to build a consensus around identified issues to drive resolution.

  • Instil a financial crimes compliance ethic as best practice and basic instinct within the business as a whole, ensuring that the business appreciates the role of compliance and respects it.

  • Actively participate as a member of the business; ensuring peers are kept abreast of key financial crimes regulatory developments and providing relevant functional input to broader business discussions in Hong Kong and Singapore.

  • Understand the current status of financial crimes compliance related projects and advise those projects.

Key Requirements:

Experience

  • Demonstrate a comprehensive understanding of the financial crimes legal and regulatory environment within Hong Kong and Singapore and have an awareness of equivalent law and regulation in jurisdictions relevant to the firm.

  • Have in depth experience of Sanctions obligation as relevant to asset management practices

  • Have in depth experience of KYC and CDD

  • Have acted in an advisory capacity at all levels of management and staff on the practical implementation of financial crimes compliance.

  • Be up-to-date on current developments in the in relation to identifying, measuring and managing financial crimes risk and regulatory obligations particularly with regards to Sanctions and AML/CTF obligations for Hong Kong and Singapore.

  • Be able to demonstrate experience of working in a global environment / international business, across time zones.

  • Demonstrable experience in building relationships at the local, regional and global level – including the ability to partner constructively and collaboratively in a matrix environment.

  • Ability to initiate and drive projects required to satisfy evolving regulatory requirements and that support the on-going development of the compliance framework, demonstrating effective stakeholder management.

  • Clear and considered commercial judgment, including the ability to calmly operate in a high pressure or crisis situation.

  • Relationship management: proven track record in stakeholder relationship management across the global arena. Possess gravitas, maturity and credibility to build and develop relationships with key stakeholders and clients both internal and external both at Board level and senior management.

Qualifications

  • Have attained an industry core professional qualification in a business/compliance discipline or law and demonstrate international business skills and / or have attained sufficient industry experience within the Financial Crime and/or Compliance discipline.
